RESUMO
The present study it has as objective to demonstrate the constitutionality of the politics of affirmative action for the ingression of afro-Brazilians in the universities, from the constitutional reading of the principle of the equality, of the international treated ones to human rights and a series of other devices constitutional and infraconstitutional, which not only support as also they stimulate the adoption of the measure. It has in sight, the historical debt of the Brazilian State with the blacks and of the necessity of the urgent enrollment of all the society in the equalization of the problem of the racial relations in Brazil.
