RESUMO

Multiples are the social parameters and contingencies that can launch or disclose diffuse interests. The simple possibility of grouping and associating propitiates a trend to the mobilization of the interests. These associations aim at the defense and protection of the interests of the group and each integrant member. In the present study are boarded the great advantages of the class actions mainly the collective mandamus, and its positive and innovating effects. It is also evidenced that even with all this evolution and awareness related to diffuse rights and interests, many are the obstacles and varied the difficulties. Chapter I distinguishes some pertinent concepts to the class actions. Differentiating rights and interests; diffuse, collective and homogeneous individual interests. Chapter II characterizes three class actions (public civil action, public interest action and collective mandamus) related to the diffuse right. And Chapter III carries through a deepened analysis regarding the collective mandamus, highlighting its mechanisms of guardianship of diffuse, collective and individual homogeneous interests. And as a whole the report emphasizes that is and will be always prudent that social forces dedicate themselves to face its daily and current problems, searching for solutions that strengthen the initiative power of the individuals, groups, boroughs and communities. Being important that more and more the society presents questions and files actions that propitiate the diffuse interests.
