RESUMO

This work analyses legal protection of the archaeological cultural heritage in Brazil and presents new principles and instruments for their preservation. Based on the Constitution, the study begins with a general approach to cultural rights and cultural patrimony linking these subjects to the policies that should be adopted by the Brazilian government. Later it deals with the safeguard of Brazilian cultural heritage, especially of its archaeological aspects, exploring the concept of archaeology and archaeological sites, and stating the legal and instrumental tools for their protection. The characteristics of the Brazilian archaeological heritage and its legal treatment, particularly after the inactment of the environmental protection legislation is dealt with in the last part of this work, with the purpose of providing a theoritical and instrumental ground that enables a more effective protection of our archaeological heritage markedly when subject to potentially indagering activities
